Shyamkanu Mahanta Moves Gauhati High Court Seeking Bail

Guwahati: One of the main accused in the widely discussed death case of popular singer Zubeen Garg, Shyamkanu Mahanta, has approached the Gauhati High Court seeking bail after his earlier plea was rejected by a Fast Track Court.

It may be mentioned that on April 30, the Special Fast Track Court had rejected Mahanta’s bail application. While rejecting the plea, the court observed that the accused could potentially abscond if granted bail at this stage, making it inappropriate to release him.

Following the lower court’s decision, Shyamkanu Mahanta has remained in judicial custody. Challenging the order, he has now filed a fresh bail petition before the Gauhati High Court. The case has been registered as Bail Application No. 3853/2026.

The petition was initially submitted before the High Court on May 6. However, due to certain technical discrepancies in the filing, the matter could not proceed immediately. After the petitioner corrected the objections and procedural errors, the High Court officially registered the application on May 11. The hearing will be conducted in connection with CID Police Station Case No. 18/2025.

The case, which initially surfaced as a suspicious death, later took a dramatic turn after investigators treated it as a murder case. Assam Chief Minister Himanta Biswa Sarma had earlier publicly referred to the incident as a “murder,” following which the investigation intensified.

The Special Investigation Team (SIT) of Assam Police CID has already completed its investigation and submitted a chargesheet before the court. A total of seven accused have been named in the chargesheet. Along with Shyamkanu Mahanta, the other accused currently in jail are Siddhartha Sharma, Shekharjyoti Goswami, Amrit Prabha Mahanta, Sandeepan Garg, Nandeswar Boro and Paresh Baishya.

Earlier, the court had also rejected a custody petition filed by Shyamkanu Mahanta’s wife.

According to investigators, several seized mobile phones, SIM cards and digital messages are being treated as important electronic evidence in the case. Meanwhile, the court had earlier ordered the freezing of multiple bank accounts linked to another accused, Siddhartha Sharma. Investigating agencies suspect that transactions exceeding ₹1 crore had taken place through those accounts.

The death case of Zubeen Garg continues to generate widespread public interest and emotional reactions across Assam. Attention is now focused on the Gauhati High Court’s decision regarding Shyamkanu Mahanta’s bail plea.
