According to Jayanta Malla Baruah, the Tourism Minister and government spokesperson, the decision to repeal the Act was motivated by the state’s move towards implementing the UCC. He emphasized Chief Minister Himanta Biswa Sarma’s clarity on the issue of UCC, stating that the repeal of the outdated British-era Act specific to Muslim marriages and divorces aligns with this vision.

Baruah further explained that under the repealed Act, Muslim marriages and divorces would no longer be registered. Instead, the government aims to encourage the registration of all marriages under the Special Marriage Act. He highlighted concerns about the misuse of the Act, particularly in facilitating marriages of minors, and expressed confidence that its repeal would be a significant step towards combating child marriage.
