Court Fixes Jan 3 for Charge Hearing; Appoints Legal Aid Counsels: Zubeen Garg Death Case

Guwahati: The trial for the death of Zubeen Garg has begun at the Sessions Court in Kamrup (Metropolitan) on Monday. The Court heard Session Case No. 256/2025 and issued important orders related to supply of case documents and legal assistance to the accused.

The court produced the accused through video conferencing from two different jails. Shyamkanu Mahanta, Siddhartha Sharma, Sandeepan Garg, Paresh Baishya and Nandeshwar Bora appeared from Nikachi District Jail at Mushalpur in Baksa district. Shekar Jyoti Goswami and Amritprabha Mahanta appeared from Sub-Jail, Haflong in Dima Hasao district.

Advocate Gabriel Sahu appeared for accused Amritprabha Mahanta and filed vakalatnama. Chief Legal Aid Counsel Dhurbajyoti Das was also present.

After checking the records, the court noted that the Investigating Officer had already submitted soft copies of the charge-sheet and other important documents in a pen drive. The court also reviewed the committal order dated December 16, 2025.

The court found that jail authorities had given hard copies of the charge-sheet to the accused persons but had not supplied hard copies of other important documents. The lawyer for Amritprabha Mahanta informed the court that he had received all soft copies of the documents. The court accepted this and treated document supply for him as complete.

The court directed the Investigating Officer to supply hard copies of all important documents to all accused persons except Amritprabha Mahanta within one week, as required under Section 193(8) of BNSS.

As the accused are lodged in two different jails, the court appointed Deputy Legal Aid Defence Counsels to assist Chief Legal Aid Counsel Dhurbajyoti Das. The court also asked jail authorities to help lawyers meet the accused.

The court fixed January 3, 2026, as the next date for production of the accused and consideration of charge.
